What is the time frame allowed to file an Inheritance Tax form? If a person died in January, 2008, does the family have to file a tax form? If not what is the Statue to quote? |

If the decedent passed away in January, the estate will use a short calendar year for its income tax return -- from the date of death through December 31. The return will be due on April 15 of the following year, unless an extension is requested.
There is also a gross estate return, if the estate is over $5,000,000 (2011 threshold), that is due nine months after the date of death. For most estates that need this type of return, the attorney or accountant requests an extension almost automatically.
